These Terms and Conditions (“Terms”) cover your use of and access to the sites, templates, trainings, applications, tools and features provided by FLAG Self Defense Academy. Our Privacy Policy explains what personal information we collect and how it’s used and shared.
1. Interpretation and Variation
1.1 In the Terms and Conditions the following definitions apply:
“Company” means FLAG Self Defense Academy “Participant” means any person that has completed a purchase or opted in online which has been accepted by the Company. “Affiliates” means any of the Affiliates of FLAG Self Defense Academy as published on our website from time to time. “Terms and Conditions” as defined here.
“Website” means www.flagselfdefense.com or affiliated websites.
1.2 The Company reserves the right to vary or revoke any of the Terms and Conditions from time to time which it may consider necessary or suitable for the regulation of the governance and the conduct of Participants. Any such changes will be published on our websites until revoked, are binding on Participants.
1.3 The Terms and Conditions shall be governed by the laws of South Africa and subject to the exclusive jurisdiction of the Durban courts.
2. Agreement
2.1 Subject to condition 2.2, when a person has completed a purchase or opted in online, they shall become a Participant of the assigned training.
2.2 Acceptance of a person as a Participant is at the discretion of the Company.
2.3 The Company reserves the right to withdraw, suspend or refuse to renew the Agreement of any Participant whose conduct is, or may deemed to be in the Company’s reasonable opinion, injurious to the character of the training or amounts to a breach of the Terms and Conditions or where such expulsion is otherwise to be in the interests of the other Participants of the training. Any Participant so expelled shall forfeit all privileges to the Agreement and shall not be entitled to any refund for any period during which his or her Agreement is suspended.
3. Payment Terms
3.1 Details of prices are available on our website or shall be such prices as determined by the Company from time to time.
3.2 Subject to any statutory right of cancellation, payments for events and annual payments are made non-refundable unless otherwise stated in the Terms and Conditions.
3.3 Courses, Lectures, Seminars, Workshops, Events and Affiliate Training programs with the Company are non-refundable.
4. Fitness & Health
4.1 Participants are advised not to undertake strenuous physical activities without first seeking medical advice if they have concerns over their physical condition. The Company reserves the right to refuse access to any Participant if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by participating in a training.
4.2 Participants and their guests must notify the trainer of any circumstances affecting their health, which may be exacerbated through continued use.
5. General Guidelines
5.1 Participants must at all times observe the trainers guidelines which may be notified to them from time to time and are requested to comply with any reasonable directions which the trainer may issue to ensure the smooth operation of the training for the convenience of all Participants.
5.2 The Company may, if a Participant so wishes communicate with the Participant by “email”. By providing an email address to the Company the Participant consents to receive email communications from the Company, including notices pursuant to the Terms and Conditions. The Participant also accepts any risk that email may not be a fully secure and confidential means of communication. The Company will not be liable for any loss or damage suffered as a result of communicating with a Participant in this manner.
6. Limitation of Liability
6.1 It is the Participant’s responsibility to ensure that they are capable of undergoing a routine of exercises provided by any program that they follow or event that they attend. Participants accept the risk of injury from performing exercises and are advised to consult their doctor prior to beginning any program or training. The Company accepts no liability for loss or damage to property or injury of Participants or their guests to them on the training premises or outside the training location except in so far as such loss, damage, or injury is by law incapable of exclusion.
6.2 The Company does not guarantee in any way that by attending a Course, Lecture, Seminar, Workshop or Event that you will never be attacked or that you will be successful in defending yourself with the techniques that you have learnt. The Company will not be held liable for any loss, damage or injury to person or property of any nature. The Company is released from any liability of any nature including negligence. The techniques taught and learnt are for educational & recreational purposes, The Company can not be held responsible and is released from any liability in the use of these techniques and any loss, damage or injury to person or property of any nature in any scenario.
